Clay County Homicide Suspect Arrested for Murder

The Nebraska State Patrol has arrested the suspect in a Friday evening homicide in rural Harvard.

Sunday, troopers served an arrest warrant for Toby Gray. Gray is currently receiving treatment for a self-inflicted gunshot wound at Bryan Health West Campus in Lincoln.

At approximately 8:30 p.m. Friday, the Clay County Sheriff’s Office requested the Nebraska State Patrol’s assistance in response to a homicide that had occurred at 1640 Road 322, in rural Harvard.

Deputies had responded to that address after receiving a 911 call from the suspect threatening harm against the victim. Upon arrival, deputies located a deceased female with multiple gunshot wounds and a male with an apparent self-inflicted gunshot wound. There were also three young children inside the home when deputies arrived. The children were taken into protective care and have been placed with family.

NSP investigators have determined that the male subject, Toby Gray, 39, entered the home and shot the victim, Heather Gray, 35. Toby Gray then shot himself. The two were married, but authorities have learned that Heather Gray was planning a divorce.

Toby Gray was transported to Aurora Memorial Hospital and was then flown to Bryan Health West Campus in Lincoln with life-threatening injuries, where he remains at this time.

Gray has been arrested for first degree homicide and use of a weapon to commit a felony. Following service of the arrest warrant, custody of Gray has been transferred from troopers to the Clay County Sheriff’s Office.
